General terms and conditions

Principal Edition, located at Molenstraat 62/0002, 2830 Willebroek, Belgium, with company number [LATER IN TE INVULLEN], offers its products and services under the following terms and conditions. By placing an order or using our website, you agree to be bound by these terms and conditions.

 

1. Scope

1.1 These general terms and conditions apply to all Principal Edition products, services and agreements.
1.2 Deviations from these terms and conditions are valid only if agreed in writing.

 

2. Products and delivery

2.1 Principal Edition provides digital scores in pdf format. A printed copy can optionally be ordered.
2.2 Digital products are delivered immediately after payment via e-mail and made available in the customer’s personal account.
2.3 The customer is responsible for providing correct contact details. In case of errors in the e-mail address provided, Principal Edition cannot be held liable for failed deliveries.

 

3. Orders and payments

3.1 All prices are displayed in euros and include VAT, unless otherwise stated.
3.2 Payment can be made via Bancontact, PayPal, Apple Pay or Payconiq.
3.3 An order will not be processed until full payment has been received.

 

4. Exclusion of right of withdrawal

4.1 Due to the nature of our products (digital downloads), the legal right of withdrawal does not apply, as stipulated in Article VI.53 of the Belgian Code of Economic Law.
4.2 When placing an order, the customer acknowledges that delivery will take place immediately after payment and that there is no possibility of cancellation or refund.

 

5. Copyrights and restrictions on use

5.1 All scores supplied by Principal Edition are protected by copyright.
5.2 Customers receive a personalized pdf bearing a watermark identifying the owner. It is strictly forbidden to copy, distribute or circulate these files without prior permission from Principal Edition.
5.3 Violation of these terms and conditions, such as file sharing between individuals or associations, will result in legal action and may result in claims for damages.
5.4 Principal Edition cooperates with Sabam, and the composers involved receive compensation in accordance with the applicable agreements.

 

6. Liability

6.1 Principal Edition is not responsible for indirect damages, such as loss of profits, loss of data or consequential damages.
6.2 Our liability is limited to the value of the order that gave rise to the dispute.
6.3 Technical failures or interruptions in access to our website or systems are considered force majeure and cannot result in compensation.

 

7. Force Majeure

7.1 In the event of force majeure, our obligations will be temporarily suspended or, if the situation continues, the contract may be terminated.
7.2 Force majeure includes, but is not limited to: failures in IT systems, cyber attacks, strikes, natural disasters and other circumstances beyond our control.

 

8. Complaints and Disputes

8.1 Complaints about our products or services can be made at info@principaledition.com. We will deal with any complaint within a reasonable period of time.
8.2 In case of disputes, we will strive for an amicable solution. If this is not possible, the matter will be submitted to the competent courts of Belgium.

 

9. Intellectual property rights

9.1 All materials, including scores, logos, text and designs, are the exclusive property of Principal Edition or its suppliers and are protected by copyright and other intellectual property rights.
9.2 It is prohibited to use, copy or distribute these materials without our express written permission.

 

10. Privacy and data processing

10.1 Principal Edition processes personal data in accordance with applicable privacy legislation. More information can be found in our Privacy and Cookie Statement.
10.2 The customer agrees to the processing of necessary data for processing orders and improving our services.

 

11. Final Provisions

11.1 If any provision of these general terms and conditions is declared invalid, the remaining provisions shall remain in full force and effect.
11.2 These terms and conditions are governed exclusively by Belgian law.
